It is perhaps most useful to approach the Doctor-Patient relationship (DPR) by admitting that it’s complicated. We review some of the strategies that have been employed to mitigate this complexity, zeroing in on one that promises to capture the main features of the DPR without eliminating some of its more important, existential components; pieces of the puzzle that must be retained if we are to avoid oversimplification and the errors that can arise by ignoring important foundational properties. We believe that (...) a useful way to look at the DPR and to capture essential features that must be balanced in the process is provided by Partnership Theory and its definition in terms of the so-called domination and partnership systems. We apply this theory to the DPR and investigate the implications of this application to health care. We see that in the absence of mitigating circumstances, adoption of the patient-as-partner model serves healthcare well and is flexible enough to accommodate circumstances that dictate modifications. Clearly, Marx thought he was promoting democratic values. In the Manifesto, the immediate goal of socialism is summed up as “to win the battle of democracy.” Marx sees the reduction of individuality as one of the greatest injuries done by a system in which most people buy and sell their labor power on terms over which they have little control. As they supervised translations and re-issues of the Manifesto, Marx and Engels singled out just one point as a major topic (...) on which their view in 1848 had been superseded. Past criticisms to the contrary, methodological individualism in the social sciences is neither trivial nor obviously false. In the style of Weber's sociology, it restricts the ultimate explanatory repertoire of social science to agents' reasons for action. Although this restriction is not obviously false, it ought not to be accepted, at present, as a regulative principle. It excludes, as too far-fetched to merit investigation, certain hypotheses concerning the influence of objective interests on large-scale social phenomena. And these hypotheses, in fact, (...) merit empirical consideration. The attractiveness of methodological individualism as a regulative principle depends on two independent confusions, the conflation of an agent's reasons for action with the beliefs, needs, desires, or goals which are the reasons why he acted as he did, and the identification of explaining a phenomenon and describing its causes. In a wide-ranging inquiry Richard W. Miller provides new resources for coping with the most troubling types of moral conflict: disagreements in moral conviction, conflicting interests, and the tension between conscience and desires. Drawing on most fields in philosophy and the social sciences, including his previous work in the philosophy of science, he presents an account of our access to moral truth, and, within this framework, develops a theory of justice and an assessment of the role of morality in (...) rational choice. In Miller's view, we are often in a position to claim that our moral judgments are true descriptions of moral facts. But others, relying on contrary ways of moral learning, would reject truths that we are in a position to assert, in dissent that does not depend on irrationality or ignorance of relevant evidence or arguments. With this mixed verdict on "moral realism," Miller challenges many received views of rationality, scientific method, and the relation between moral belief and moral choice. In his discussion of justice, Miller defends the adequacy, for modern political choices, of a widely shared demand that institutions be freely and rationally acceptable to all. Drawing on social research and economic theories, he argues that this demand has dramatically egalitarian consequences, even though it is a premise of liberals and conservatives alike. In the final chapters, Miller investigates the role and limits of morality in the choice of conduct, arguing for new perspectives on reason and impartiality. Originally published in 1992. Three standard tasks undertaken by applied ethicists engaged in the public policy process are identifying value issues, clarifying concepts and meanings, and analyzing arguments. I urge that these should be expanded to include making specific moral judgments and advocating positions and policies. Three objections to philosophers/ethicists' engagement in the formation of public policy are advanced and evaluated: philosophers necessarily do public policy badly, doing it at all compormises one's integrity as a seeker after truth, and frequently participation is in the (...) service of a repressive status quo that is structured simultaneously to preclude radical change and to co-opt ethicists. finally, however, I argue that those who would be ‘applied ethicists’ cannot avoid all participation in some form of a public policy process; that engagement holds the hope as well for improved ethical theory; that the preferred form of participation is frequently from outside of establishment bodies; and that wherever philosophers do involve themselves in policy formulation, this is best done in the expanded sense urged at the outset. For the most part, philosophers have regarded moral truth as propositional and as what follows from the application of moral theory to particular problematic cases. Here I maintain that this is not a useful way of conceiving moral truth in bioethics. Rather, we are better off conceiving of moral truth as what emerges from a process of inquiry conducted in a certain manner. There are four elements to this process: (1) careful exploration of the embedded norms of medical practice, research, (...) and delivery; (2) recognition of the irreducible plurality of ultimate moral values within and between these practices; (3) the cultivation and exercise of moral imagination; and (4) the attainment, however temporarily, of wide reflective equilibrium. This process, I argue, is reflected in the way bioethics is most fruitfully practiced, and it is further to be recommended by being true to the character of moral conscientiousness generally. This analysis suggests that moral truth is "unstable," but that this is not a bad thing. Further, the implication is drawn that moral theory would be better informed if formulated on the basis of paying more attention to lived moral practices. (shrink)

Type II DNA topoisomerase activity is required to change DNA topology. It is important in the relaxation of DNA supercoils generated by cellular processes, such as transcription and replication, and it is essential for the condensation of chromosomes and their segregation during mitosis. In mammals this activity is derived from at least two isoforms, termed DNA topoisomerase IIα and β. Professor Hutchings’ discussion of my views on the ontology of works of art pushes my argument further and clarifies some of the issues by relating them to scholastic ontology, both in traditional and in recent formulations. However, Hutchings misconstrues my argument in two important respects: he attributes to me a narrower view of ‘analogical method’ and of the term ‘equivocal’ than I actually hold and so consequently misses the sense in which the ‘ontological commitment’ the critic according to me will (...) be presupposed in aesthetic discussions. Since the clarification of these disagreements will throw light on the ontology of art, I should like to summarize Hutchings’ critical remarks relevant to points and and then briefly indicate my answers to these criticisms and their relevance to aesthetic theory. In this bold work of broad scope and rich erudition, Richard W. Miller sets out to reorient the philosophy of science.

Michael Polanyi began thinking and writing about tradition long before he met Edward Shils in 1946. Polanyi’s religious experience in 1913 became part of the background for his thinking about tradition, and tradition entered into his thinking about spontaneous order and moral inversion. Polanyi and Shils both knew Karl Mannheim before they met one another, and had similar criticisms of Mannheim’s sociology. Soon after they met, both Polanyi and Shils were briefly enthusiastic about the Action Frame of Reference, which Shils (...) helped create. Neither of them used the Action Frame of Reference in their later work. One of the reasons was its neglect of tradition, and another was that is was simply too complex to be a useful conceptual tool. Polanyi’s thinking about tradition did not change much after Personal Knowledge, but Shils continued to modify his thinking about tradition until the final years of his life. (shrink)

Hany metaethicists have all but abandoned the possibility that ordinary value language has any sort of universal logic. But careful phenomenological reflection indicates that we call something “good” only if we tacitly believe that it is disposed to be “pragmatically attractive” in some way. Conversely, “bad” things must be “pragmatically repellent”. Linguistic and phenomenological evidence supports these observations. Differences in the meanings of diverse value judgments seem to be due to variations in the practical context in which the attraction or (...) repulsion is judged. The fact that we can legitimately request clarification regarding each of five practical dimensions tends to indicate that a common structure underlies all senses in which something can be said “good” or “bad.”. According to Paul Ricoeur, the Freudian unconscious invalidates the ability of Husserlian phenomenology to explicate human psychology. The stumbling block is said to be the mechanism of repression, which can not only obviate conscious access to certain ideas and motives but also distort consciousness itself. The whole enterprise of phenomenology would seem to be at stake. But we must carefully distinguish being a conscious object from being a conscious process. By means of ?micro?phenomenology?, the reflective analysis of focal dynamics, I (...) shall try to reconstruct the so?called unconscious as certain conscious processes we are unable to reflect on as conscious objects. This reconstruction utilizes two motivational principles of attention, motive attraction and motive repulsion, which affect the manner in which attention addresses its object. The principles explain how reflective consciousness can be so repelled by certain directly conscious events that it withdraws with subliminal rapidity, leaving those events reflectively unconscious. Various sorts of evidence, including experimental results in subliminal psychology, can be used to support this phenomenological hypothesis. Though hypothetical, the theory at least demonstrates that the existence of unconscious processes is not an a priori basis for dismissing phenomenological methodology. (shrink)

Rather than dealing with the important issues in the interpretation of behavioural data, Heyes seems only to reiterate lessons well-learned before she first reviewed the topic of primate deception. She also appears to misrepresent a series of published analyses. Despite her emphatic denials, the commonsense view is the best: informed observations and experiments can both provide evidence of theory of mind.
